Required documents

Registration in the "Asycuda World" Information System:

In order to carry out import/export operations, the economic agent must first register in the information system of the Customs Service, "Asycuda World." To do this, it is necessary to submit to the Customs Office within the jurisdiction of the economic agent, the Extract from the State Register of Legal Entities issued by the Public Services Agency. The document must be issued in the current month of registration in the customs system. After the registration is confirmed, you can perform import/export transactions.

 

Documents required for customs clearance:

According to Order No. 123-O of the Customs Service dated April 4, 2023, the necessary documents for submitting the declaration are the documents that confirm the information stated in the customs declaration, as well as a minimum of the following mandatory documents:

 

  • 1) Commercial documents - types of documents used in foreign trade, required by customs authorities to determine the value of imported goods (cost). Commercial documents include: commercial invoice, proforma invoice, definitive invoice, and others. The contract under which the goods were delivered refers to the international commercial contract, which is the agreement of will made between two or more participants in international trade from different countries, establishing, modifying, or terminating legal relationships of international trade (Vienna Convention of 1980).

 

  • 2) Transport and customs documents - types of documents used according to the type of transport and in compliance with the legislation: CMR (road transport letter), SMPS/SMGS (railway transport letter), AirWayBill (air freight letter), Bill of lading, TIR Carnet, ATA Carnet, transit customs declaration (T1), transport manifest, and others that confirm the legality of the goods transportation operation.
  • 3) Permit documents, required for granting customs clearance (where applicable) - permit documents specified in the List of Permit Documents issued by the issuing authorities to individuals and legal entities for conducting entrepreneurial activities (licenses, permits, approvals, certificates, permits) provided in Annex No.1 to the Law on Regulation through Authorization of Entrepreneurial Activity No. 160/2011, as well as those that establish restrictions on the import and export of goods, and other documents necessary for customs clearance, granting customs and fiscal facilities (humanitarian aid, technical assistance and investment projects, etc.) and including documents confirming the granting of customs and fiscal facilities, in accordance with the legislation.

 

  • 4) Additional documents recognized in accordance with international trade practices (where applicable) - documents necessary for the implementation of provisions regulating the free circulation of declared goods, other than those mentioned in points 1), 2), and 3).

 

Additional documents are provided when there is a basis for their request by the customs authority, in accordance with the provisions of point 292 of the Regulation on the Application of Customs Destinations provided by the Customs Code of the Republic of Moldova, approved by Government Decision No. 1140/2005.

The request for additional documents by the customs authority is mentioned in the inspection report, which is immediately made available to the declarant and becomes mandatory for presentation in the customs process, if they are generally recognized documents in accordance with international trade practices and acceptable for issuance by the exporter or authorized bodies, based on legal reasoning and the protection of trade secrets. The inability to provide additional documents cannot be used as a basis for refusing to accept the customs declaration.
