Diversified Preferential Rules of Origin in Free Trade between the Republic of Moldova and Ukraine:

The Customs Service informs that on May 24, 2023, the provisions of the Protocol between the Government of the Republic of Moldova and the Cabinet of Ministers of Ukraine amending the Free Trade Agreement between the Government of the Republic of Moldova and the Cabinet of Ministers of Ukraine of November 13, 2003, signed in Chisinau on August 28, 2021, ratified by Law no. 210/2021 (hereinafter referred to as the Protocol), entered into force.

This fact will contribute to facilitating the exchange of goods between the Republic of Moldova, member countries of the European Union, CEFTA countries, the Republic of Turkey, and Ukraine.

Another goal of this Protocol is to develop economic and trade cooperation based on equality and mutual benefit, as well as to create conditions for the free movement of goods.

Thus, within the framework of bilateral preferential trade carried out under the Free Trade Agreement between the Government of the Republic of Moldova and the Cabinet of Ministers of Ukraine, the EUR.1 movement certificate or the declaration of origin applied to a commercial document is used to confirm the preferential origin of goods. These documents are prepared based on the Regional Convention on Preferential Rules of Origin Pan-Euro-Med, to which the Republic of Moldova acceded through Law no. 111/2015 (hereinafter referred to as the PEM Convention), or based on the Alternative Rules of Origin provided for in Appendix A to the Protocol (hereinafter referred to as the Alternative Rules).

Furthermore, the Republic of Moldova and Ukraine are parties to the Agreement on the Free Trade Area (hereinafter referred to as the CIS Agreement), signed in St. Petersburg on October 18, 2011, ratified by Law no. 201/2012, within which the Agreement on the Rules for Determining the Country of Origin of Goods in the Commonwealth of Independent States of November 20, 2009 (hereinafter referred to as the 2009 Rules) applies.

Therefore, in the case of preferential transactions between the Republic of Moldova and Ukraine carried out under the CIS Agreement, the CT-1 form of the origin certificate, issued in accordance with the provisions of the 2009 Rules, will be used.

In this context, in order to examine the possibility of applying cumulation of origin based on the rules of origin provided for in the PEM Convention or the Alternative Rules, the cumulation matrix published in the Official Journal of the EU, series (C), should be consulted. The latest updates were published on October 15, 2021, regarding the PEM Convention, and on February 10, 2023, regarding the Alternative Rules.
